Who’s fooling who?
The Shar’ee position on Tasmiya at the time of slaughtering. (A Fiqhi response to the Majlis)
After the removal of the copious amount of stuffing with which this pamphlet has been gratuitously amplified, and once the impulse to respond in kind has been overruled by deeper wisdom and greater decency, the core argument of this diatribe is reduced to one simple claim: that the four madhahib are in agreement on the issue of the tasmiyah during slaughter.

MJC Withdraws 2 certificates
The Muslim Judicial Council Halaal Trust has withdrawn its halaal certification for two fast food outlets in the Western Cape. According to Nabeweya Malick, PRO for the ulema body, the certification was withdrawn because both Wimpy in Ottery and Nandos in Upper Long Street, Cape Town failed to comply with stringent halaal requirements. She did not provide further details.
However, Malick said, the withdrawal of the halaal certification should give the public peace of mind that the halaal issuing authority did not hesitate to act when it became aware that its halaal criteria were not fully being met. One of the criteria set by all halaal issuing authorities is the absence of any alcohol on the premises of a certified outlet. It also requires that some of the staff on sight be Muslims who can oversee the halaal handling of food.
“The MJC has very high halaal standards. I cannot reveal why the certification were withdrawn, but you can be sure that something had happened to make the MJC unwilling to put its halaal stamp on these places. So it is important for our community not to support these stores,” Malick said. She added that it was an important notice for Muslims to take note of since it was generally accepted that most Nandos outlets in the Western Cape were halaal.

THE TWO VIOLATED FUNDAMENTALS OF THABAH RAINBOW, EARLYBIRD AND ALL COMMERCIALLY KILLED CHICKENS AT NON-MUSLIM KILLING FACILITIES AND ALL FRANCHISE OULETS PREPARING THESE CHICKENS ARE HARAAM BECAUSE THE FOLLOWING TWO FUNDAMENTALS FOR THE MEAT TO BE HALAAL ARE GROSSLY AND TOTALLY VIOLATED AND DISREGARDED:
(1) TASMIYAH: OMISSION OF ALLAH’S NAME IS THE NORM AND IS PRACTISED ON A MASSIVE SCALE (2) NECK-CUTTING IS EXTREMELY HAPHAZARD. A SIGNIFICNT FACT OF EVIDENCE FOR THIS CLAIM IS THAT THE NIHT HAS ESTABLISHED BY ITS INSPECTION OF SANHA’S CERTIFIED ANCA CHICKEN PLANT THAT DESPITE THE LINE SPEED BEING ‘ONLY’ 16 BIRDS PER MINUTE, THE END RESULT WAS 87% HARAAM CHICKENS. 1
INTRODUCTION
RESPONSE TO THE LIES OF SANHA’S LACKEY
In response to a concerned Brother, one Mr.Siraj Desai of Port Elizabeth, deeming it appropriate to align himself in defence of SANHA, the flag-ship of the halaalizer of haraam carrion chickens, structured his letter on the basis of lies, fabrications and pure slanders. For the claims of slander and baseless suppositions which he has advanced in defence of SANHA, he is not able to present a single valid, rational substantiation.

What happened to Tony Naidoo
Readers recall a Tony Naidoo´s circulation of an email entitled “Hoodwinked by Halaal” falsely lambasting Halaal certifiers with innuendos and untruths.
He spoke on national radio on the 6th of March 2008 and a Muslim radio station where he denigrated Halaal certification as “exploitive, basically dishonest, an outright scam and an evil practice,” amongst many other cruel utterances.
1. Where is Tony Naidoo?
Despite giving him a sound drubbing on national radio, SANHA extended an invitation to Naidoo to meet with us. Not only did he not take this up, but has failed to forward a physical address to us or our attorneys to meet him. He does not have the courage to apologise or stand for his convictions, preferring to hide behind the anonymity of an email address.
2. Failure to provide any evidence
Notwithstanding his claims such as “documentary proof of a ´four year longitudinal survey´ that 80% of products purchased at supermarkets carry the Halaal emblem” and false charges of funds derived from Halaal being channelled “to advance Islamic political causes” he has failed to provide a single shred of evidence on this and his other allegations.
( For related articles in this matter go to www.sanha.org.za )
3. Contact with other Islamic bodies
In a divide and rule type of tactic to curry favours with some organisation and individuals Naidoo has communicated with the Jamiatul Ulama of KwaZulu-Natal and the Port Elizabeth tabloid, the Majlis in this matter. We wonder about the outcome of this contact of the strangest kind. And even stranger is the fact that other bodies have chosen not to speak out against Naidoo´s attack. Their silence is deafening.
4. Will the real Tony Naidoo stand up?
Although claiming to be the chairman of a “fully-constituted national advocacy body campaigning to bring to an end the manner in which Halaal is implemented in SA” his letterhead reflects his email address as ccc@concernedchristiancouncil.co.za and his landline fax of 032 533-3802 carries the telefax ID of “Jivannadi Christian School” Perhaps there is something more than meets the eye here?
The ground swell of support from both Muslims and non-Muslims has been most encouraging and in the spirit of the message of the Noble Qur’aan where it is said in Surah 3, Verse 64
“Say: ‘O People of the Book! come to common terms as between us and you: that we worship none but Allah; that we associate no partners with Him; that we erect not, from among ourselves, Lords and patrons other than Allah.”

Question was posed wether it be permissible to eat at stores owned by non Muslim or even Muslim but serves alcohol but the meat comes from Halaal certified sources. Many are of the opinion and this due to ignorange of deen and sometimes also weak Imaan that it is ok to eat at such places. Someone suggested that Chicken has been made Halaal by Allah so there is nothing wrong with it.
Never mind chicken, even fish from outlets that sell liquor must be avoided. Over and above the meat there are issues such as procurement of all raw materials, sauces, seasonings, ingredients, preparation, processing, handling, equipment used, Islamic hygiene, etc right through to delivery and serving which have to be taken into consideration.
If a Muslim ownes a store and sell liquor which is completly against the order of Allah then we should defenitly abstain from such places for such a person CANNOT be trusted with regards to Halaal/Haraam.

KFC recipe’s security
Colonel Sander’s handwritten recipe of 11 herbs and spices was moved on 9 September 2008 from KFC’s headquarters for the first time in decades. The temporary relocation is allowing KFC to revamp security around a yellowing sheet of paper that contains one of the most famous corporate secrets.
So important is the 68-year old concoction that coats the chain’s original recipe chicken that only two company executives at any time have access to it. The company refuses to reveal their names or titles and uses multiple suppliers who produce and blend the ingredients but know only a part of the entire contents.
For more than 20 years the recipe has been tucked away in a filing cabinet equipped with two combination locks in company headquarters. To reach the cabinet, the keepers of the recipe would first open up a vault and unlock three locks on a door that stood in front of the cabinet. Vials of the herbs and spices are also stored in the secret filing cabinet.
One of the two keepers of the recipe said in an interview at KFC headquarters that the actual recipe would include some surprises.
KFC had a total of 14892 locations worldwide at the end of 2007.
SANHA has no knowledge on the KFC formula and has NOT issued certification to any KFC store.

Some of the UK’s best-selling chocolate bars, such as Mars and Twix, will no longer be suitable for vegetarians.
Also affecting brands such as Snickers and Maltesers, owner Masterfoods said it had started to use animal product rennet to make its chocolate products. Masterfoods said the change was due to it switching the sourcing of its ingredients and the admission was a “principled decision” on its part. The Vegetarian Society said the company’s move was “incomprehensible”.
‘Extremely disappointed’
Masterfoods said it had started using rennet from 1 May and non-affected products had a “best before date” up to 1 October.
|
Rennet, a chemical sourced from calves’ stomachs, is used in the production of whey.It will now also be found in Bounty, Minstrels and Milky Way products, and the ice cream versions of all Masterfoods’ bars.
“If the customer is an extremely strict vegetarian, then we are sorry the products are no longer suitable, but a less strict vegetarian should enjoy our chocolate,” said Paul Goalby, corporate affairs manager for asterfoods.
The Vegetarian Society said it was “extremely disappointed”.
“At a time when more and more consumers are concerned about the provenance of their food, Masterfoods’ decision to use non-vegetarian whey is a backward step,” it said in a statement.
“Mars products are very popular with young people and many will be shocked to discover that their manufacture now relies on the extraction of rennet from the stomach lining of young calves,” it added.
“P.S we are still waiting for confirmation wether these are Halaal or Not.”

SANHA certifies Isreali butchers
Q: 1. Do you (SANHA) have any qualms and conscience convulsions for having, issued halaal certificates to the Israeli butchers who daily murder Palestinian Muslims?
Q: 2. Do you (SANHA) have any Islamic and emotional feelings for the suffering Palestinian Muslims who are suffering under the grinding boots of Israel?
Name of the person who posed the question removed
Answer
* SANHA has not issued any Halaal certificates to any Israeli butchers. Please provide your proof of yet another unfounded falsehood.
* We are on record on this issue wherein we stated in our newsletter no 17 of April 2008 for all to see wherein we stated…
In the case of the sacred land of Palestine which is home to Masjid al-Aqsa, the third most holiest site in Islam, we shall never recognize its occupation and we pray for its liberation. Anyone who is not affected by the sufferings of our Palestinian brethren is at best, weak in faith. Whatever actions our Ulama and leadership suggest should be followed and encouraged within the bounds of Shariah.
Wassalaam

Gelatine with Halaal stamp?
Q: There has been quite a lot of controversy regarding the Gelatine issue. It is alleged that most of the Ulama accept gelatine from non-Halaal animals as Halaal on the basis of transformation and metamorphosis.
Answer
Some Ulama contend that there is a drastic change in the non-Halaal animal material used in gelatine manufacture thereby rendering non-Halaal animal material as Halaal. The SANHA Fatwa Committee does not concur with this view and has adopted a very holistic position on gelatine and other such ingredients of non-Halaal animal origin used in food production.
This committee has ruled that the use of non-Halaal animal raw material is not acceptable in the manufacture of food products due to the fact that abundance of Halaal raw material is available. They have also argued that why should we as Muslims look for technical loopholes (metamorphosis etc.) to justify the use of Haraam animal raw materials in food production. Food producers should be made cognisant and aware of the needs of Muslim’s and should accordingly procure Halaal raw materials. The global Muslim population constitutes almost 1.8 billion people and most of this community is not vegetarian i.e. we are consumers of meat. Furthermore, we are not faced with such a predicament that gelatin-based products cannot be avoided.
“Remember, the industry will only change if we present our requirements and assert our needs.”

Rainbow Haraam Chickens?
A SUMMARY OF OUR REFUTATION OF MUFTI RADHAUL HAQ’S ‘FATWA’ Mufti Radhaul Haq of Madrasah Zakariyya had undertaken a pre-arranged mock inspection of Rainbow Chickens under the auspices of SANHA. Subsequently, the Mufti issued a ‘fatwa’ declaring Rainbow’s haraam killing system to be permissible.
Since the Mufti’s ‘fatwa’ was not a Shar’i Fatwa – rather it was a product of personal opinion unsubstantiated by evidence of the Shariah – we prepared a refutation which is in book form consisting of 140 pages. The book is currently under print. Whoever wishes, may write for a copy of the book. In this SUMMARY we have condensed the main arguments of the Mufti and our response.
Opinion expressed here is not necessarily that of halaal.wodpress.com and those behind it.
(1) FACING THE QIBLAH A requirement of the Shariah’s system of Thabah (Slaughtering) is that both the slaughterer and the animal should be facing the Qiblah. The Mufti’s argument: According to the Hanafi Math-hab there are two views: Sunnatul Muakkadah and Mustahab. According to the other three Math-habs, facing the Qiblah is Mustahab. For the sake of facilitating the slaughtering process of Rainbow Chickens, it is best to adopt the second view, viz., Istihbaab (Mustahab) of the Hanafi Math-hab so that there is uniformity with the other three Math-habs. In view of the Qiblah being Mustahab, the implication is that its omission is a non-issue which has no effect. OUR RESPONSE: The argument of the Mufti is baseless. There are no two views in the Hanafi Math-hab. According to the Hanafi Math-hab, the Qiblah requisite is Sunnatul Muakkadah. There is no Istihbaab view. The Mufti has confused the literal meaning of the term with its technical meaning, hence his erroneous extrapolation of Istihbaab plunged him into extravagation – into error. His claim that according to the other three Math-habs, the Qiblah factor is Mustahab, is likewise baseless. According to all three Math-habs, it is Sunnatul Muakkadah, hence its omission is unanimously haraam (Makrooh Tahrimi). Read the elaboration in our Book of Refutation. Thus, the Qiblah requisite is not a non-issue. Its omission is haraam. The Mufti’s argument is his personal opinion based on conspicuous error in understanding the Kutub.

Slaughtering Process

Broiler Chickens
I will briefly go through the process of how most big chicken abattoirs operate. Big meaning anything above 5000 chickens per day. Some of the following procedures are practised by smaller farms too.
Step1. The chickens arrive at the slaughter house at a average age of 6 weeks (40 days old).
Step2. The chickens are placed onto a automatic chain hanging upside down.
Step3. The chickens go through the stunner which is a half drum filled with water and has low voltage current.¹ (The current is to stun the chicken making them passive for a few minutes to make it easy for the slaughterers.)
Step5. The chicken reaches a long drum with hot water to to make the defeathering process easy.
Step6. The chicken heads which is still hanging goes into a narrow metal line so that the heads can be pulled off.
Step7. The chicken gets defeather and cut up
¹ Issue arises as to whether the voltage is sometimes too high and the chicken dies before getting slaughtered

Mufti Siraj view on Chicken SAGA
Assalaamu alaykum
Jazakallah for your email. I must apologise again for the delay. I also received the email containing an attachment titled “Zaahid’s lament”. Let me respond to that as well as the recent statements by slaughterers.
Before proceeding with my explanation, it is important to understand that the issue of halaal and haraam poultry is no longer confined to academic debate and divergence; instead the matter has unfortunately degenerated to a level of personal conflict and vendetta. The background to this conflict that has become very personal must be born in mind. Some of the parties concerned have openly declared that they will not rest until Sanha has been silenced, ‘destroyed’, and totally obliterated.

To whomsoever it may concern
This email was sent to the various Ulama councils and others involved.
The incessant and vicious bombardment to the public on the halaal status of chickens refers.
The objective that you wished to achieve has been achieved. The Muslim public has been made fully aware of your opinion on chickens slaughtered on certain plants.
As a concerned Muslim, I wish to bring to your notice that we have become laughing stock amongst the non – Muslims. No other event in the history of this country has sowed so much of discord and disunity amongst the Muslims. Do I now question my sister as to were she bought her chicken from when she invites me for lunch? Do I show distrust towards or question her imaan?

ZAAHID is a current slaughterer at the Earlybird Chicken plant in Olifantsfontein, Gauteng. He has been in the employ of Earlybird for the past two decades (20 years). In a conversation with Mufti Shuayb Ravat, senior Ustaadh at Ashraful Madaaris, De Deur, who was one of the panel of four inspectors (three Ulama and one Haafiz), Zaahid pouring out the years of pent-up frustration and the sufferings of his Imaani conscience, spoke frankly and said:
“Maulana, I know the history of all these things (i.e. the corruption taking place at Earlybird Chicken plant). These people are out for business. They are not looking after Muslims. So they don’t think for the interests of the people (Muslim people). As you know, they don’t think for the Ummah. Each and everything they do is just for business.

The Muslim Judicial Council(MJC) hereby unequivocally states and confirms that all chickens slaughtered at MJC certified farms are halaal and suitable for Muslim consumption.
The MJC is a body of Ulema which has been involved with the halaal certification of foods for Muslim consumption for over 60 years and conducts its slaughtering procedures according to strict Islamic guidelines. As a leading and experienced global halaal certifying Islamic organization, the MJC continues to be consulted by international Islamic organizations about halaal operations and procedures abroad.
We therefore take strong exception to baseless allegations by the unknown, newly established “Scholars of the Truth”, which is led by their counsel Zehir Omar, who made public appeals to South African Muslims to refrain from consuming chickens certified by MJC.
We also take exception to the fact that Zehir Omar who claims to be the spokesperson for the “Scholars of Truth” takes it upon himself to label all chickens haraam and thereby creating unnecessary confusion in this community.
We declare once again that all our halaal operations are conducted under the strictest halaal requirements.
End.

MACDONALDS McDonald’s announced in the 1990’s that it changed its frying oil from animal fat to vegetable oil for those who are vegetarian. However, it turned out that this information did not turn out to be completely true French fries are fried slightly in animal fat then frozen and shipped to all the McDonald’s stores for the final frying The following information was announced on the Arabic BBC channel Basically, what they do is they cut the potatoes into slices and then coat them with a thin layer of lard (pig fat) or cow fat so that when it is fried it will crunch. Then these fries are shipped to McDonald’s stores in different parts of the world including India and the Arab countries. Mc Donald’s apologized to the Indians after receiving complaints, since a good number of Indians do not eat anything that has ingredients derived from animals. And of course no apology has been made to the Arab countries.
So in summary, Mc Donald’s fries is coated with a layer of either cow fat or lard (pig fat which is thicker and cheaper) then shipped to all Mc Donald’s stores over the world, which is then fried in vegetable fat.
Please alert all those you know of this information.
